- अगर किसी महिला के खिलाफ बल प्रयोग कर उसे निर्वस्त्र किया जाता है तो आईपीसी की धारा 354-बी के तहत 3 साल से 7 साल तक कैद की सजा का प्रावधान किया गया है।

-354 सी के तहत प्रावधान है कि अगर कोई शख्स किसी महिला के प्राइवेट ऐक्ट की तस्वीर लेता है और उसे लोगों में फैलाता है तो ऐसे मामले में एक साल से 3 साल तक की सजा का प्रावधान है। अगर दोबारा ऐसी हरकत करता है तो 3 साल से 7 साल तक कैद की सजा का प्रावधान है।
- आईपीसी की धारा 354-सी के तहत वोयरिज्म (अश्लील हरकत देखकर आनंदित) के मामले में पीडि़ता की शिकायत पर एक साल से लेकर 3 साल तक कैद की सजा का प्रावधान कर दिया गया है।

-354 डी के तहत प्रावधान है कि अगर कोई शख्स किसी महिला का जबरन पीछा करता है या कॉन्टैक्ट करने की कोशिश करता है तो ऐसे मामले में दोषी पाए जाने पर 3 साल तक कैद की सजा का प्रावधान है।
- स्टॉकिंग यानी जानबूझकर किसी का पीछा करना, ऐसा कर उसकी मानसिक शांति में खलल डालना (इसके लिए फोन, ईमेल, इलेक्ट्रॉनिक या अन्य कोई भी माध्यम हो) के मामले में धारा 354-डी के तहत एक साल से लेकर 3 साल तक कैद की सजा का प्रावधान किया गया है।

Rape
16 दिसंबर की गैंग रेप की घटना के बाद सरकार ने वर्मा कमिशन की सिफारिश पर ऐंटि रेप लॉ बनाया गया है। इसके तहत जो कानूनी प्रावधान किए गए हैं, उसमें रेप की परिभाषा में बदलाव किया गया है। सीनियर ऐडवोकेट रमेश गुप्ता के मुताबिक, आईपीसी की धारा-375 के तहत रेप के दायरे में प्राइवेट पार्ट या फिर ओरल सेक्स दोनों को ही रेप माना गया है। साथ ही प्राइवेट पार्ट के पेनिट्रेशन के अलावा किसी चीज के पेनिट्रेशन को भी इस दायरे में रखा गया है।

अगर कोई शख्स किसी महिला के प्राइवेट पार्ट या फिर अन्य तरीके से पेनिट्रेशन करता है तो वह रेप होगा।

Explanation.— In this section, "sexual intercourse" shall mean any of the acts mentioned in clauses (a) to (d) of section 375 of the Indian Penal Code.'.]

The Protection of Children from Sexual Offences Act, 2012
बच्चों के खिलाफ बढ़ते यौन अपराध को रोकने के लिए और बच्चों को ऐसे अपराधों से संरक्षण देने के लिए सरकार ने 14 नवंबर 2012 में प्रोटेक्शन ऑफ चिल्ड्रन अगेंस्ट सेक्शुअल ऑफेंसेस (पोक्सो) ऐक्ट बनाया था। ऐसे मामलों का जल्द से जल्द निपटारा हो और दोषियों को सजा सुनाए जाने से अपराध पर लगाम लगे। ये मामले संज्ञेय अपराध की श्रेणी में आते हैं। नाबालिग बच्चों को प्रोटेक्ट करने के लिए यह कानून बनाया गया है। प्रोटेक्शन ऑफ चिल्ड्रेन फ्रॉम सेक्शुअल ऑफेंसेज (पोक्सो) ऐक्ट जेंडर न्यूट्रल कानून है और पिछले साल 14 नवंबर से प्रभावी है। 18 साल से कम उम्र के बच्चों (लड़का या लड़की) के साथ किसी तरह का सेक्शुअल ऑफेंस पोक्सो कानून के तहत अपराध होगा। इसमें पेनेट्रेटिव या नॉन पेनेट्रेटिव दोनों तरह के ऐक्ट के लिए सजा का प्रावधान है। बच्चों को अगर किसी भी तरह से सेक्शुअली अब्यूज किया जाता है, जिनमें पॉरनॉग्रफी आदि के जरिये शोषण भी शामिल है, तो इसके लिए सख्त सजा का प्रावधान किया गया है। इस कानून में सजा का प्रावधान, अपराध की गंभीरता के हिसाब से किया गया है लेकिन गंभीर मामलों में उम्रकैद तक की सजा भी दी जा सकती है।

महिलाओं के यौन उत्पीड़न के खिलाफ कार्यस्थल पर सुरक्षा विधेयक, 2013
The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013
उच्चतम न्यायालय द्वारा निर्धारित यौन उत्पीड़न की परिभाषा के आधार पर इस विधेयक का मसौदा तैयार किया गया है। उच्चतम न्यायालय ने विशाखा वनाम राजस्थान-1997 के मामले में यौन उत्पीड़न की परिभाषा निर्धारित की थी।
इस विधेयक में कार्यस्थल पर महिलाओं के खिलाफ कामकाज के प्रतिकूल माहौल तथा महिला के रोजगार के भविष्य को धमकी या प्रलोभन को भी यौन उत्पीड़नमाना जाएगा।

इस विधेयक में कार्यस्थलों में काम करने वाली महिलाएं ही नहीं बल्कि वहां आने वाली महिलाओं, ग्राहकों प्रशिक्षओं तदर्थ तथा दैनिक वेतन पर काम करने वाली महिलाओं को भी दायरे में लाया गया है।
कालेज एवं विश्वविद्यालयों में छात्रों तथा शोधार्थियों एवं अस्पताल में महिला मरीजों को भी इस विधेयक के दायरे में लाया गया है। इसके अलावा असंगठित क्षेत्र में भी यह विधेयक लागू होगा।
विधेयक में महिलाओं की शिकायतों को दूर करने के लिए एक आन्तरिक विकास समिति गठित करने का भी प्रावधान है।
वर्ष 2005 की आर्थिक जनगणना के अनुसार चार करोड़ 18 लाख 30 हजार कार्यस्थलों में से चार करोड़ 12 लाख 20 हजार कार्यस्थलों पर 10 से कम महिलाएं काम करती हैं। विधेयक में स्थानीय शिकायत निवारण समिति का प्रावधान किया गया है। यह समिति जिलाधिकारी या नियोक्ता की सिफारिशों की जांच पडताल करेगी।
अगर कोई दफ्तर इस विधेयक के प्रावधानों को नही मानता है तो उस पर 50 हजार रुपए तक का दंड किया जा सकता है।
विधेयक के अनुसार महिलाओं को जांच के दौरान अगर किसी तरह के हमले या धमकी की आशंका हे तो वह अपना तबादला करवा सकती है या प्रताड़ित करने वाले व्यक्ति का भी तबादला करवा सकती हैं या फिर खुद बीमारी की छुट्टी पर जा सकती है।
शिकायत समिति 90 दिन के भीतर जांच करेगी और नियोक्ता को 60 दिन के भीतर समिति की सिफारिशें लागू करनी होंगी।
विधेयक में यौन उत्पीड़न के झूठे तथा दुर्भाग्यपूर्ण शिकायतों के खिलाफ रक्षा का भी प्रावधान है। अगर कोई अपनी शिकायतों को सही ठहराने के लिए पर्याप्त प्रमाण नहीं दे पाता है तो वह सजा का भागीदार नही होगा।
केंद्रीय प्रतिष्ठानों में इस कानून को लागू करना केन्द्र सरकार की जिम्मेदारी है। जबकि राज्यों में राज्य सरकारों की जवाबदेही होगी।
राज्य सरकार तथा केन्द्र सरकार प्रस्तावित विधेयक की निगरानी की जांच करेगी तथा कार्मिक रिपोर्ट में उनकी जानकारी देनी होगी।
विधेयक के तहत इसके क्रियान्वयन की रिपोर्ट नियोक्ता को तैयार करनी होगी तथा उस संबंध में आंकड़ों को भी ध्यान में रखना होगा।
 
सरकारी और निजी कार्यस्थलों पर महिलाओं का यौन उत्पीड़न रोकने के उद्देश्य से तैयार किए गए विधेयक को लोकसभा ने मंजूरी दे दी है.
सोमवार को सदन में कोयला आवंटन के मुद्दे पर जारी शोर शराबे के बीच कार्यस्थलों पर महिलाओं का यौन उत्पीड़न (रोकथाम, निषेध और सुधार) अधिनियम -2010 बिना चर्चा के पारित कर दिया गया.
इस प्रस्तावित कानून के तहत शारीरिक संपर्क, शारीरिक संबंध बनाने की मांग या आग्रह या अश्लील टिप्पणियां करना या अश्लील सामग्री दिखाने को यौन उत्पीड़न माना जाएगा.
किसी भी तरह के अवांछित शारीरिक, मौखिक या गैर मौखिक यौन व्यवहार को भी यौन उत्पीड़न के दायरे में रखा गया है.
इस कानून का उल्लंघन करने पर 50 हजार रुपये के जुर्माने का प्रावधान किया गया है.
अगर बार-बार इसका उल्लंघन किया जाता है तो जुर्माने की राशि बढ़ा दी जाएगी और जिस कार्यस्थल पर ऐसा होगा, उसका लाइसेंस या रजिस्ट्रेशन रद्द किया जा सकता है.
सभी क्षेत्र शामिल

सरकार कामकाजी महिलाओं की सुरक्षा के लिए इस बिल को महत्वपूर्ण बता रही है.
कृष्णा तीरथ ने कहा, “अभी तक यौन उत्पीड़न को रोकने के लिए संगठित क्षेत्र खास कर सरकारी दफ्तरों में कमेटी बनाई गई थी. असंगठित क्षेत्र में ऐसा नहीं था. अब हमने इसमें संगठित और असंगठित क्षेत्र के साथ-साथ घरेलू काम करने वाली महिलाओं को भी शामिल किया है. इसके दायरे में निजी, गैर सरकारी और व्यवसायिक क्षेत्र के सभी प्रतिष्ठानों को लिया गया है.
इस प्रस्तावित कानून में घर में काम करने वाली नौकरानी को एक ऐसी महिला के तौर पर परिभाषित किया गया है जिसे नकद राशि या अन्य तरीके से दिए जाने वाले मेहनताने पर घर का काम करने के लिए घर के मालिक ने खुद या किसी एजेंसी के जरिए अस्थायी या स्थायी तौर पर रखा है. लेकिन उसे काम पर रखने वाले परिवार के किसी सदस्य को उत्पीड़न से संरक्षण देना इस कानून की परिधि में नहीं आता.
इसका मतलब है कि ये विशेष रूप से कामकाजी महिलाओं को ध्यान में रख कर तैयार किया गया है.
आंतरिक कमेटी का प्रावधान
"अब हमने इसमें संगठित और असंगठित क्षेत्र के साथ साथ घरेलू काम करने वाली महिलाओं को भी लिया है. इसके दायरे में निजी, गैर सरकारी और व्यवसायिक क्षेत्र के सभी प्रतिष्ठानों को लिया गया है."

इस विधेयक का जायजा लेने वाली स्थायी संसदीय समिति की मजबूत राय है कि विधेयक में प्रतिबिंबित होने वाला रोकथाम का पहलू सुप्रीम कोर्ट के निर्देशों के मुताबिक होना चाहिए जो उसने 1997 के विशाखा वाद के संबंध में दिए गए थे.
इस मामले में सुप्रीम कोर्ट के फैसले में न सिर्फ कार्य स्थलों पर यौन उत्पीड़न को परिभाषित किया गया बल्कि इसकी रोकथाम और अनुशासनात्मक कार्रवाई के लिए दिशा निर्देश भी निर्धारित किए गए.
इस विधेयक में सभी दफ्तरों, अस्पतालों, संस्थानों और अन्य कार्यस्थलों को निर्देश दिया गया है कि वे यौन उत्पीड़न से जुड़ी शिकायतों से निपटने के लिए एक आंतरिक कमेटी बनाएं. इस कमेटी का नेतृत्व कोई महिला ही करेगी.
चूंकि भारत में बहुत सारी कंपनियों में 10 से कम कर्मचारी काम करते हैं और उनके लिए ऐसी कमेटी का गठन करना संभव नहीं है, इसलिए इस विधेयक में प्रावधान है कि जिला अधिकारी स्थानीय शिकायत समिति का गठन कर सकता है.

Section 326. Voluntarily causing grievous hurt by dangerous weapons or means
Whoever, except in the case provided for by Section 335, voluntarily causes grievous hurt by means of any instrument for shooting, stabbing or cutting, or any instrument which, used as a weapon of offence, is likely to cause death, or by means of fire or any heated substance, or by means of any poison or any corrosive substance, or by means of any explosive substance, or by means of any substance which it is deleterious to the human body inhale, to swallow, or to receive into the blood, or by means of any animal, shall be punished with 1[imprisonment for life], or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
CLASSIFICATION OF OFFENCE
Punishment—Imprisonment for life, or imprisonment for 10 years and fine—Cognizable—Non-bailable—Triable by Magistrate of the first class—Non-compoundable.
Section 326A:
Whoever causes permanent or partial damage or deformity to, or burns or maims or disfigures or disables, any part or parts of the body of a person or causes grievous hurt by throwing acid on or by administering acid to that person, or by using any other means with the intention of causing or with the knowledge that he is likely to cause such injury or hurt, shall be punished with imprisonment of either description for a term which shall not be less than ten years but which may extend to imprisonment for life, and with fine:
Provided that such fine shall be just and reasonable to meet the medical expenses of the treatment of the victim:
Provided further that any fine imposed under this Section shall be paid to the victim.
Section 326B.
Whoever throws or attempts to throw acid on any person or attempts to administer acid to any person, or attempts to use any other means, with the intention of causing permanent or partial damage or deformity or burns or maiming or disfigurement or disability or grievous hurt to that person, shall be punished with imprisonment of either description for a term which shall not be less than five years but which may extend to seven years, and shall also be liable to fine.
Explanation 1:
For the purposes of Section 326A and this Section, "acid" includes any substance which has acidic or corrosive character or burning nature, that is capable of causing bodily injury leading to scars or disfigurement or temporary or permanent disability.
Explanation 2:
For the purposes of Section 326A and this Section, permanent or partial damage or deformity shall not be required to be irreversible.]
Section 354: Assault or criminal force to woman with intent to outrage her modesty
Whoever assaults or uses criminal force to any woman, intending to outrage or knowing it to be likely that he will thereby outrage her modesty, 1[shall be punished with imprisonment of either description for a term which shall not be less than one year but which may extend to five years, and shall also be liable to fine.]
CLASSIFICATION OF OFFENCE
Punishment—Imprisonment for 2 years, or fine, or both—Cogniza­ble—Bailable—Triable by any Magistrate—Non-compoundable.
Section 354A.
(1) A man committing any of the following acts—
(i) physical contact and advances involving unwelcome and explicit sexual overtures; or
(ii) a demand or request for sexual favours; or
(iii) showing pornography against the will of a woman; or
(iv) making sexually coloured remarks, shall be guilty of the offence of sexual harassment.
(2) Any man who commits the offence specified in clause (i) or clause (ii) or clause (iii) of sub-Section (1) shall be punished with rigorous imprisonment for a term which may extend to three years, or with fine, or with both.
(3) Any man who commits the offence specified in clause (iv) of sub-Section (1) shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.
Section 354B.
Any man who assaults or uses criminal force to any woman or abets such act with the intention of disrobing or compelling her to be naked shall be punished with imprisonment of either description for a term which shall not be less than three years but which may extend to seven years, and shall also be liable to fine.
Section 354C.
Any man who watches, or captures the image of a woman engaging in a private act in circumstances where she would usually have the expectation of not being observed either by the perpetrator or by any other person at the behest of the perpetrator or disseminates such image shall be punished on first conviction with imprisonment of either description for a term which shall not be less than one year, but which may extend to three years, and shall also be liable to fine, and be punished on a second or subsequent conviction, with imprisonment of either description for a term which shall not be less than three years, but which may extend to seven years, and shall also be liable to fine.
Explanation 1:
For the purpose of this Section, "private act" includes an act of watching carried out in a place which, in the circumstances, would reasonably be expected to provide privacy and where the victim's genitals, posterior or breasts are exposed or covered only in underwear; or the victim is using a lavatory; or the victim is doing a sexual act that is not of a kind ordinarily done in public.
Explanation 2:
Where the victim consents to the capture of the images or any act, but not to their dissemination to third persons and where such image or act is disseminated, such dissemination shall be considered an offence under this Section.
Section 354D. (1) Any man who—
(i) follows a woman and contacts, or attempts to contact such woman to foster personal interaction repeatedly despite a clear indication of disinterest by such woman; or
(ii) monitors the use by a woman of the internet, email or any other form of electronic communication, commits the offence of stalking:
Provided that such conduct shall not amount to stalking if the man who pursued it proves that—
(i) it was pursued for the purpose of preventing or detecting crime and the man accused of stalking had been entrusted with the responsibility of prevention and detection of crime by the State; or
(ii) it was pursued under any law or to comply with any condition or requirement imposed by any person under any law; or
(iii) in the particular circumstances such conduct was reasonable and justified.
(2) Whoever commits the offence of stalking shall be punished on first conviction with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine; and be punished on a second or subsequent conviction, with imprisonment of either description for a term which may extend to five years, and shall also be liable to fine.]
Section 370. Substitution of new Sections 370 and 370A for Section 370.
Section 370.
(1) Whoever, for the purpose of exploitation, (a) recruits, (b) transports, (c) harbours, (d) transfers, or (e) receives, a person or persons, by—
First.— using threats, or
Secondly.— using force, or any other form of coercion, or
Thirdly.— by abduction, or
Fourthly.— by practising fraud, or deception, or
Fifthly.— by abuse of power, or
Sixthly.— by inducement, including the giving or receiving of payments or benefits, in order to achieve the consent of any person having control over the person recruited, transported, harboured, transferred or received, commits the offence of trafficking.
Explanation 1.— The expression "exploitation" shall include any act of physical exploitation or any form of sexual exploitation, slavery or practices similar to slavery, servitude, or the forced removal of organs
Explanation 2.— The consent of the victim is immaterial in determination of the offence of trafficking.
(2) Whoever commits the offence of trafficking shall be punished with rigorous imprisonment for a term which shall not be less than seven years, but which may extend to ten years, and shall also be liable to fine.
(3) Where the offence involves the trafficking of more than one person, it shall be punishable with rigorous imprisonment for a term which shall not be less than ten years but which may extend to imprisonment for life, and shall also be liable to fine.
(4) Where the offence involves the trafficking of a minor, it shall be punishable with rigorous imprisonment for a term which shall not be less than ten years, but which may extend to imprisonment for life, and shall also be liable to fine.
(5) Where the offence involves the trafficking of more than one minor, it shall be punishable with rigorous imprisonment for a term which shall not be less than fourteen years, but which may extend to imprisonment for life, and shall also be liable to fine.
(6) If a person is convicted of the offence of trafficking of minor on more than one occasion, then such person shall be punished with imprisonment for life, which shall mean imprisonment for the remainder of that person's natural life, and shall also be liable to fine.
(7) When a public servant or a police officer is involved in the trafficking of any person then, such public servant or police officer shall be punished with imprisonment for life, which shall mean imprisonment for the remainder of that person's natural life, and shall also be liable to fine.
370A.
(1) Whoever, knowingly or having reason to believe that a minor has been trafficked, engages such minor for sexual exploitation in any manner, shall be punished with rigorous imprisonment for a term which shall not be less than five years, but which may extend to seven years, and shall also be liable to fine.
(2) Whoever, knowingly by or having reason to believe that a person has been trafficked, engages such person for sexual exploitation in any manner, shall be punished with rigorous imprisonment for a term which shall not be less than three years, but which may extend to five years, and shall also be liable to fine.]
Section 375. Rape
375. A man is said to commit "rape" if he—
(a) penetrates his penis, to any extent, into the vagina, mouth, urethra or anus of a woman or makes her to do so with him or any other person; or
(b) inserts, to any extent, any object or a part of the body, not being the penis, into the vagina, the urethra or anus of a woman or makes her to do so with him or any other person;
or
(c) manipulates any part of the body of a woman so as to cause penetration into the vagina, urethra, anus or any part of body of such woman or makes her to do so with him or any other person; or
(d) applies his mouth to the vagina, anus, urethra of a woman or makes her to do so with him or any other person, under the circumstances falling under any of the following seven descriptions:—
First.—Against her will.
Secondly.—Without her consent.
Thirdly.—With her consent, when her consent has been obtained by putting her or any person in whom she is interested, in fear of death or of hurt.
Fourthly.—With her consent, when the man knows that he is not her husband and that her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married.
Fifthly.—With her consent when, at the time of giving such consent, by reason of unsoundness of mind or intoxication or the administration by him personally or through another of any stupefying or unwholesome substance, she is unable to understand the nature and consequences of that to which she gives consent.
Sixthly.—With or without her consent, when she is under eighteen years of age.
Seventhly.—When she is unable to communicate consent.
Explanation 1.—For the purposes of this Section, "vagina" shall also include labia majora.
Explanation 2.—Consent means an unequivocal voluntary agreement when the woman by words, gestures or any form of verbal or non-verbal communication, communicates willingness to participate in the specific sexual act:
Provided that a woman who does not physically resist to the act of penetration shall not by the reason only of that fact, be regarded as consenting to the sexual activity.
Exception 1.—A medical procedure or intervention shall not constitute rape.
Exception 2.—Sexual intercourse or sexual acts by a man with his own wife, the wife not being under fifteen years of age, is not rape.]
Section 376. Punishment for rape
376. (1) Whoever, except in the cases provided for in sub-Section (2), commits rape, shall be punished with rigorous imprisonment of either description for a term which shall not be less than seven years, but which may extend to imprisonment for life, and shall also be liable to fine.
(2) Whoever,—
(a) being a police officer, commits rape—
(i) within the limits of the police station to which such police officer is appointed; or
(ii) in the premises of any station house; or
(iii) on a woman in such police officer's custody or in the custody of a police officer subordinate to such police officer; or
(b) being a public servant, commits rape on a woman in such public servant's custody or in the custody of a public servant subordinate to such public servant; or
(c) being a member of the armed forces deployed in an area by the Central or a State Government commits rape in such area; or
(d) being on the management or on the staff of a jail, remand home or other place of custody established by or under any law for the time being in force or of a women's or children's institution, commits rape on any inmate of such jail, remand home, place or institution; or
(e) being on the management or on the staff of a hospital, commits rape on a woman in that hospital; or
(f) being a relative, guardian or teacher of, or a person in a position of trust or authority towards the woman, commits rape on such woman; or
(g) commits rape during communal or sectarian violence; or
(h) commits rape on a woman knowing her to be pregnant; or
(i) commits rape on a woman when she is under sixteen years of age;
Or
(j) commits rape, on a woman incapable of giving consent; or
(k) being in a position of control or dominance over a woman, commits rape on such woman; or
(l) commits rape on a woman suffering from mental or physical disability; or
(m) while committing rape causes grievous bodily harm or maims or disfigures or endangers the life of a woman; or
(n) commits rape repeatedly on the same woman, shall be punished with rigorous imprisonment for a term which shall not be less than ten years, but which may extend to imprisonment for life, which shall mean imprisonment for the remainder of that person's natural life, and shall also be liable to fine.
Explanation.—For the purposes of this sub-Section,—
(a) "armed forces" means the naval, military and air forces and includes any member of the Armed Forces constituted under any law for the time being in force, including the paramilitary forces and any auxiliary forces that are under the control of the Central Government or the State Government;
(b) "hospital" means the precincts of the hospital and includes the precincts of any institution for the reception and treatment of persons during convalescence or of persons requiring medical attention or rehabilitation;
(c) "police officer" shall have the same meaning as assigned to the expression "police" under the Police Act, 1861;
(d) "women's or children's institution" means an institution, whether called an orphanage or a home for neglected women or children or a widow's home or an institution called by any other name, which is established and maintained for the reception and care of women or children.]
Section 376A. Intercourse by a man with his wife during separation
376A. Whoever, commits an offence punishable under sub-Section (1) or subSection
(2) of Section 376 and in the course of such commission inflicts an injury which causes the death of the woman or causes the woman to be in a persistent vegetative state, shall be punished with rigorous imprisonment for a term which shall not be less than twenty years, but which may extend to imprisonment for life, which shall mean imprisonment for the remainder of that person's natural life, or with death.]
Section 376B. Intercourse by public servant with woman is his custody
376B. Whoever has sexual intercourse with his own wife, who is living separately, whether under a decree of separation or otherwise, without her consent, shall be punished with imprisonment of either description for a term which shall not be less than two years but which may extend to seven years, and shall also be liable to fine.
Explanation.—In this Section, "sexual intercourse" shall mean any of the acts mentioned in clauses (a) to (d) of Section 375.]
Section 376C. Intercourse by superintendent of jail, remand home, etc.
376C. Whoever, being—
(a) in a position of authority or in a fiduciary relationship; or
(b) a public servant; or
(c) superintendent or manager of a jail, remand home or other place of custody established by or under any law for the time being in force, or a women's
or children's institution; or
(d) on the management of a hospital or being on the staff of a hospital, abuses such position or fiduciary relationship to induce or seduce any woman either in his custody or under his charge or present in the premises to have sexual intercourse with him, such sexual intercourse not amounting to the offence of rape, shall be punished with rigorous imprisonment of either description for a term which shall not be less than five years, but which may extend to ten years, and shall also be liable to fine.
Explanation 1.—In this Section, "sexual intercourse" shall mean any of the acts mentioned in clauses (a) to (d) of Section 375.
Explanation 2. —For the purposes of this Section, Explanation 1 to Section 375 shall also be applicable.
Explanation 3.—"Superintendent", in relation to a jail, remand home or other place of custody or a women's or children's institution, includes a person holding any other office in such jail, remand home, place or institution by virtue of which such person can exercise any authority or control over its inmates.
Explanation 4.—The expressions "hospital" and "women's or children's institution" shall respectively have the same meaning as in Explanation to sub-Section (2) of Section 376.]
Section 376D. Intercourse by any member of the management or staff of a hospital with any woman in that hospital

Where a woman is raped by one or more persons constituting a group or acting in furtherance of a common intention, each of those persons shall be deemed to have committed the offence of rape and shall be punished with rigorous imprisonment for a term which shall not be less than twenty years, but which may extend to life which shall mean imprisonment for the remainder of that person's natural life, and with
fine:
Provided that such fine shall be just and reasonable to meet the medical expenses and rehabilitation of the victim:
Provided further that any fine imposed under this Section shall be paid to the victim.]
1[376E. Whoever has been previously convicted of an offence punishable under Section 376 or Section 376A or Section 376D and is subsequently convicted of an offence punishable under any of the said Sections shall be punished with imprisonment for life which shall mean imprisonment for the remainder of that person's natural life, or with death.']
Section 377. Unnatural offences
Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with 1[imprisonment for life], or with imprisonment of either description for term which may extend to ten years, and shall also be liable to fine.
Explanation
Penetration is sufficient to constitute the carnal intercourse necessary to the offence described in this Section.

Two-finger test (TFT)
A doctor performs the test by inserting a finger into the female's vagina to check the level of vaginal laxity, which is used to determine if she is "habituated to sexual intercourse".
